1. About These Terms

These terms govern your purchase of original paintings, prints, and commissioned artwork from Kim McCauley Art (“we,” “us,” “our”) through this website. By placing an order, you agree to these terms.

2. Products

Original paintings are one-of-a-kind. Once sold, that specific piece is no longer available.

Prints (paper and canvas) are made to order by our print fulfillment partner and shipped directly to you on our behalf.

Custom commissions are governed separately by our Commission Agreement, provided to you when a commission is booked.

3. Pricing and Payment

All prices are listed in US dollars. Payment is processed securely through Square at the time of purchase. We do not store your card details.

4. Shipping

We currently ship to the United States, Ireland, France, and the United Kingdom. Shipping costs shown at checkout are estimates; production and shipping times vary by piece and destination. If you’re outside these countries and would like to order, please contact us directly at kim@kimmccauley.com to arrange shipping.

5. Returns and Refunds

Because prints are made to order specifically for you, all sales are final except in cases of damage during shipping or a printing defect. If your print arrives damaged or defective, contact us within 14 days of delivery at kim@kimmccauley.com with photos, and we will arrange a replacement or refund.

6. Intellectual Property

All artwork, images, and designs on this site are the copyrighted property of Kim McCauley. Purchasing an original piece or a print grants you ownership of that physical item only — it does not grant any right to reproduce, copy, or commercially use the artwork or its image.

7. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages arising from your use of this website or your purchase, to the fullest extent permitted by law.

8. Governing Law

These terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles.
